Abusive or Harmful Content
- Creating or transmitting voice content that is harassing, threatening, abusive, defamatory, or otherwise objectionable
- Impersonating or misrepresenting your identity or affiliation
- Engaging in fraudulent activities or scams
- Creating or transmitting sexually explicit, obscene, or offensive content
- Promoting discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age
- Promoting violence, hatred, or illegal activities
System Abuse
- Attempting to gain unauthorized access to our systems or networks
- Interfering with or disrupting the integrity or performance of the Service
- Testing or attempting to breach our security measures
- Reverse engineering our AI voice technology
- Using the Service to distribute malware or other harmful code
- Excessive use beyond reasonable business requirements
Spam and Unwanted Communications
- Mass unsolicited calls to individuals who have not provided consent
- Telemarketing calls without proper consent and disclosures
- Automated calls without proper identification and opt-out mechanisms
- Repeatedly calling the same numbers in a short period
- Using the Service primarily for cold-calling campaigns
Voice AI Agent Disclosure Requirements
When using our Voice AI Agent service, you must ensure that:
- All AI voice agent interactions include clear disclosure that the recipient is speaking with an automated AI system, not a human
- The AI voice agent identifies itself as an automated assistant or AI agent at the beginning of the conversation
- The AI voice agent identifies the company or organization it represents
- Recipients are provided with an easy way to speak to a human representative if available
- Recipients are provided with a clear method to opt out of future automated calls if applicable
These disclosure requirements align with ethical AI practices and evolving regulatory guidance regarding AI voice technologies.
Compliance with Telemarketing and Communications Laws
You must comply with all applicable laws and regulations governing telephone communications, automated calling systems, and telemarketing, including but not limited to:
- The Telephone Consumer Protection Act (TCPA)
- The Federal Trade Commission's Telemarketing Sales Rule (TSR)
- Federal Communications Commission regulations
- State-specific telemarketing laws
- CAN-SPAM Act (for any associated email communications)
- International communications regulations where applicable
These laws generally require:
- Prior express consent for automated calls in many circumstances
- Respect for Do Not Call registries and company-specific opt-out requests
- Proper identification of the calling party
- Calling only during permitted hours (typically 8am-9pm in the recipient's time zone)
- Maintaining records of consent and call activities
You are responsible for understanding and complying with all requirements applicable to your specific use case and jurisdiction. Failure to comply with these regulations may result in significant legal penalties, for which Kalem will not be responsible.
Monitoring and Enforcement
We reserve the right to monitor your use of the Service to ensure compliance with this policy and applicable laws. We may, at our discretion:
- Review call patterns and usage statistics for suspicious activity
- Sample call recordings and transcripts to verify compliance
- Investigate complaints received from call recipients or regulatory authorities
- Require you to provide evidence of consent and compliance
- Take appropriate action against violations, including warning, suspension, or termination of service
